1. INTRODUCTION
These Terms of Use ("Terms") govern your access and use of the CheckMyCar platform,
including its website and mobile application (collectively, the "Platform"), operated by
CheckMyCar, LLC ("CheckMyCar," "we," "us," or "our"), a company organized under the laws of
the State of California, United States.
By creating an account, booking an inspection, making a payment, or otherwise using the
Platform, you acknowledge that you have read, understood, and agreed to be bound by these
Terms and our Privacy Policy. If you do not agree to any provision of these Terms, you must
immediately discontinue use of the Platform.
2. DEFINITIONS
• "Client": A registered user seeking a vehicle inspection through the Platform.
• "Mechanic" or "Inspector": An independent professional holding a valid license issued by
the California Bureau of Automotive Repair (BAR) and/or an ASE certification, providing
vehicle inspection services through the Platform.
• "Inspection": A pre-purchase vehicle assessment performed by a Mechanic at the location
of the vehicle, booked through the Platform.
• "Report": The document issued by the Mechanic summarizing inspection findings, scores,
photographs, and recommendation.
• "Platform": The CheckMyCar website, mobile application, and all associated services.
• "User": Any individual accessing or using the Platform, including Clients and Mechanics.
3. NATURE OF SERVICES
CheckMyCar operates as a digital marketplace that connects Clients with independent, certified
Mechanics for pre-purchase used vehicle inspections. CheckMyCar does not itself perform
vehicle inspections, does not employ Mechanics, and does not act as an agent for any Mechanic.
Mechanics listed on the Platform are independent contractors who have been verified by
CheckMyCar to hold valid BAR licenses and/or ASE certifications. While CheckMyCar verifies
credentials and monitors service quality through ratings and reviews, CheckMyCar does not
guarantee the accuracy, completeness, or reliability of any individual inspection or report.
Inspection reports are informational tools intended to assist Clients in making informed vehicle
purchase decisions. They do not constitute a warranty, guarantee, or legal certification of the
vehicle's condition, value, safety, or fitness for any particular purpose. Clients are encouraged to
exercise their own judgment and, where appropriate, seek additional professional opinions before
making a purchase decision.
4. ACCOUNT ELIGIBILITY AND REGISTRATION
To create an account and use the Platform, you represent and warrant that:
• You are at least 18 years of age;
• You are legally capable of entering into binding contracts under applicable law;
• All registration information you provide is accurate, current, and complete;
• You will promptly update your registration information to maintain its accuracy;
• You will maintain the confidentiality of your login credentials and are solely responsible for
all activity under your account;
• You will immediately notify CheckMyCar of any unauthorized use of your account.
CheckMyCar reserves the right to refuse registration, suspend, or terminate any account at its
sole discretion.
5. BOOKING AND INSPECTION PROCESS
When booking an inspection through the Platform, the Client agrees to:
• Provide accurate and complete information about the vehicle to be inspected, including
make, model, year, mileage, VIN (if available), and the location where the vehicle can be
accessed;
• Ensure that the vehicle is accessible to the Mechanic at the agreed-upon date, time, and
location;
• Be present at the inspection location, as the Mechanic will meet the Client at the vehicle's
location and walk the Client through the findings on the spot;
• Not interfere with or obstruct the Mechanic's inspection process;
• Treat the Mechanic with respect and professionalism at all times.
6. PAYMENTS AND BILLING
• All payments are processed securely through Stripe, a third-party payment processor.
CheckMyCar does not store credit card or bank account information on its servers.
• Clients pay the full inspection fee at the time of booking.
• The current standard inspection rate is $220 USD per inspection. CheckMyCar reserves
the right to adjust pricing at any time, with notice provided on the Platform.
• Applicable taxes, including California sales tax where required by law, will be calculated
and displayed at checkout.
• No direct cash payments, checks, or off-platform payments are permitted.
• In case of a payment dispute, you agree to contact CheckMyCar at contact@check-my-
car.com before initiating any chargeback with your financial institution. Unauthorized
chargebacks may result in account suspension and collection proceedings.
7. CANCELLATION AND REFUND POLICY
7.1 Client-Initiated Cancellation
• Cancellations made more than 48 hours before the scheduled inspection are eligible for a
full refund.
• Cancellations made between 24 and 48 hours before the scheduled inspection are subject
to a 50% cancellation fee.
• Cancellations made less than 24 hours before the scheduled inspection, or no-shows, are
non-refundable.
7.2 CheckMyCar-Initiated Cancellation
If CheckMyCar or the assigned Mechanic must cancel an inspection for any reason, the Client will
receive a full refund or the option to reschedule at no additional cost.
7.3 Refund Processing
Refunds, when applicable, are processed within 7 business days to the original payment method.
8. INSPECTION REPORTS
8.1 Ownership
All inspection reports generated through the Platform are the exclusive property of CheckMyCar.
The Client receives a non-exclusive, non-transferable license to use, store, and share the report
for personal, non-commercial purposes related to the vehicle purchase decision.
8.2 Accuracy
While CheckMyCar requires Mechanics to perform inspections diligently and in good faith,
inspection reports reflect the Mechanic's professional opinion based on a visual and functional
assessment performed at a specific point in time. Reports do not cover hidden defects, future
mechanical failures, or conditions that cannot be detected through a standard on-site inspection.
8.3 Vehicle Data
The Client acknowledges that vehicle information provided during the booking process (including
VIN, mileage, location, and seller contact information) will be shared with the assigned Mechanic
solely for the purpose of completing the inspection. This data will be retained by CheckMyCar in
accordance with our Privacy Policy.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHECKMYCAR, ITS
OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES,
INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER
INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE
PLATFORM, ANY INSPECTION PERFORMED, OR ANY REPORT ISSUED, WHETHER
BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER
LEGAL THEORY.
CHECKMYCAR'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT
OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT
EXCEED THE AMOUNT YOU PAID TO CHECKMYCAR IN THE TWELVE (12) MONTHS
PRECEDING THE CLAIM.
You acknowledge and agree that you waive the protections of California Civil Code Section 1542,
which provides: "A general release does not extend to claims that the creditor or releasing party
does not know or suspect to exist in his or her favor at the time of executing the release and that, if
known by him or her, would have materially affected his or her settlement with the debtor or
released party."
10. DISPUTE MEDIATION
In the event of a dispute between a Client and a Mechanic regarding the quality, accuracy, or
conduct of an inspection, CheckMyCar will make reasonable efforts to mediate the dispute, which
may include reviewing the inspection report, collecting statements from both parties, and
proposing a resolution. However, CheckMyCar's mediation is voluntary and non-binding, and
CheckMyCar assumes no liability for the outcome of any dispute between a Client and a
Mechanic.
11. ACCEPTABLE USE
Clients agree to:
• Use the Platform solely for its intended purpose of booking vehicle inspections;
• Interact respectfully and professionally with Mechanics and CheckMyCar staff;

through the Platform for vehicle inspection services outside the Platform;
• Bypass, circumvent, or attempt to circumvent CheckMyCar's payment system, scheduling

account termination, legal action, and a claim for damages including but not limited to the lost
commission revenue.

• You may submit reviews and ratings of Mechanics based on your genuine experience.
• All reviews must be honest, accurate, and non-defamatory.
• By submitting a review, you grant CheckMyCar a perpetual, worldwide, royalty-free license
to use, display, and reproduce the review on the Platform and in marketing materials.
• CheckMyCar reserves the right to remove, edit, or refuse to publish any content that
violates these Terms, is abusive, misleading, or otherwise inappropriate.
14. INTELLECTUAL PROPERTY
All content, branding, trademarks, logos, software, algorithms, and design elements on the
Platform are the exclusive property of CheckMyCar or its licensors. You may not reproduce,
modify, distribute, display, or create derivative works from any part of the Platform without express
written consent from CheckMyCar.
15. ACCOUNT SUSPENSION AND TERMINATION

YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED

OF OR RELATED TO THESE TERMS.

17. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of
California, without regard to its conflict of law provisions. Any litigation not subject to arbitration
shall be brought exclusively in the state or federal courts located in Los Angeles County,
California.
18. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless CheckMyCar, its officers, directors,
employees, agents, partners, and affiliates from and against any and all claims, liabilities,
damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in
connection with:
• Your use or misuse of the Platform;
• Your violation of these Terms or any applicable law;
• Your interactions with Mechanics, sellers, or other third parties;
• Any vehicle purchase decision you make based on or following an inspection.

disasters, acts of government, cyberattacks, pandemics, labor disputes, utility failures, or third-
party service outages.
20. SERVICE AVAILABILITY

21. MODIFICATIONS TO TERMS
CheckMyCar reserves the right to modify these Terms at any time. Material changes will be
communicated via the Platform, email, or push notification at least 14 days before they take effect.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of
competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid
